    摘要: 随着互联网时代的到来,网络虚拟财产应运而生。然而,网络虚拟财产却不同于传统法律意义上的物。目前关于虚拟财产法律属性的界定主要有三种:物权说,知识产权说及债权说。根据虚拟财产的特征,将虚拟财产权界定为债权更为合适,反映的是虚拟财产背后的游戏供应商与玩家之间的服务合同关系。同时应当在立法上予以完善,更好地保护虚拟财产,以促进网络经济健康、有序发展。With the development of internet, virtual properties appear. However, they are distinctive from those traditional properties of civil law. Currently, there are three opinions about legal nature of virtual properties: real rights, intellectual properties and obligatory right. In accordance with the features of virtual properties, it’s suitable to define it as a kind of obligatory right, as it reflects the contractual relationship between network game suppliers and online gamers. Meanwhile, it’s vital to improve relative legislation so as to protect virtual properties which can make sure that the net economy can develop orderly.
