未成年人网络保护的立法思考——基于英国《在线安全法案》的比较观察

Legislative Thinking on the Network Protection of Minors—Based on the Comparative Observations of the UK’s “Online Secu-rity Bill”

摘要: 信息网络时代下，如何营造有利于未成年人身心健康的网络环境，保障未成年人合法权益成为立法工作的重点。在《未成年人保护法》、《未成年人网络保护条例》等配套法律法规的保障下，我国未成年人网络保护法治建设进入了新的阶段，机遇与挑战并存。在比较法视野下，英国《在线安全法案》法案针对社交媒体平台、政府和未成年人自身制定了严格的监管标准，其中存在的问题也为我国立法实践提供了经验借鉴。在既有法律框架下，须进一步借鉴域外立法的经验，强化国际间的合作，提升校园与家庭对于未成年人自我保护意识和技能的培训力度。在各方的共同努力下，方能更好地营造出有利于未成年人身心健康的网络环境，保障未成年人合法权益得到充分保障。

Abstract: In the era of information network, how to create a network environment conducive to the physical and mental health, protect the legitimate rights and interests of minors have become the focus of legislative work. Under the guarantee of supporting laws and regulations such as the Law on the Protection of Minors and the Regulations on the Online Protection of Minors, the legal construction of the online protection of minors in China has entered a new stage, with both opportunities and challenges. From the perspective of comparative law, the British Online Security Bill sets strict regulatory standards for social media platforms, the government and minors themselves, the existing problems also provide experience for China’s legislative practice. Under the existing legal framework, it is necessary to further draw on the experience of legislation outside the region, strengthen international cooperation, enhance the training of minors’ self-protection awareness and skills in campus and families. With the joint efforts of all parties, we can better create a network environment conducive to the physical and mental health of minors and protect the legitimate rights and interests of minors fully protected.
