Risk Response Measures for International Projects under COVID-19

摘要: 新冠肺炎疫情在全球范围内大规模蔓延，我国海外工程承包商的工期延误、项目成本失控、不能如期履约的风险大幅增加，本文将依据国际承包工程项目一般实践和标准格式合同对承包商使用不可抗力规则中的共性问题进行探讨，并据此行使索赔工期延长和/或额外费用的权利，对维护承包商的合法权益提供建议。

Abstract: The COVID-19 epidemic is spreading on a large scale around the world, and the risks of delay, project cost out of control, and failure to perform the contract on time of overseas engineering contractors from China are greatly increased. This paper will discuss the common problems in the use of force majeure rules by contractors according to the general practice of international contracted engineering projects and standard form contracts. Accordingly, it exercises the right to claim for extension of construction period and/or additional costs, and provides suggestions for safeguarding the legitimate rights and interests of the enterprise.
